Our team gets a wide variety of cannabis related questions every day. These are are most common questions we recieve that have fairly straightforward answers. 

Initiative 71, which was passed in 2014, legalized the possession, cultivation, and private use of cannabis for adults aged 21 and older in Washington, D.C. Under this law, individuals are allowed to possess up to two ounces (about 56 grams) of cannabis and cultivate up to six plants in their homes, with a maximum of three plants being mature at any given time. However, it is important to note that the sale of cannabis remains illegal in D.C., except for medical use in licensed dispensaries.

The consumption of cannabis is only allowed on private property. It is still highly illegal to consume cannabis in public and especially illegal to consume cannabis on federal grounds. 

Until July 1st, 2023: in Maryland, the use of medical cannabis is legal, while the recreational use of cannabis remains illegal. The Maryland Medical Cannabis Commission oversees the state’s medical cannabis program, which allows qualified patients to obtain medical cannabis for therapeutic purposes. Patients with qualifying conditions can obtain a medical cannabis card, which grants them access to licensed dispensaries. However, it is important to note that the possession, cultivation, and distribution of cannabis for non-medical purposes are still considered illegal in Maryland and can result in legal consequences.

It’s possible to start a cannabis business in Maryland. There are bills in place to tax and regulate marijuana, with the intention of creating a regulatory system for the state’s recreational cannabis industry. Existing medical cannabis dispensaries will become dual licensees on July 1, 2023 if they pay a fee, and regulators must start approving additional marijuana business licenses by July 1, 2024. 

Licenses required to start a cannabis business in Maryland: The Maryland Cannabis Administration (MCA) has a 30-day application period for individuals and businesses interested in applying for a standard or micro cannabis license. An application must include a detailed operational plan, diversity plan, and business plan. Certain diversity criteria must be met, including a definition of a “social equity applicant” and a “disproportionately impacted area.” Detailed business plans are also required that provide an overview of the company’s objectives, sources of financing, and qualifying real estate
